I can't legally answer. A lawyer would have to do that for you. My personal opinion is that it isn't legal to take a percentage when someone is referring clients to you. It is a kickback. It is illegal here in WA State as I mentioned in my other post

What is more important is that you don't seem comfortable with it. Why don't you ask to renegotiate and tell him that you don't think it is fair. It is better to pay a flat fee for rent for the room which makes it less sticky both legally and ethically.

I was referred to your site after posting a question on Yahoo! Answers. I've found many of your posts very informative, but haven't really found a post which touched on my specific question.

I rent a room from a chiropractor. I would consider myself an independent contractor. I make my own schedule, provide my own linens and lotion, do my own billing and get paid directly by the client/patient or insurance company. But, if he sends a no-fault auto patient to me, I have to give him half my fees for that client. Is this legal? I am in Hawaii.

Not sure if you can respond, or perhaps redirect me to an appropriate post.

Thank you, Becky
